Terms of payment and delivery

Due to our greatly reduced prices, our terms of payment in the online store are exclusively prepayment or direct debit. So that our honest customers do not have to pay for defaulting customers. Shipping and packaging costs are waived for all orders over € 21.00. For lower order values, we charge a shipping fee of € 5.95 per package.

1. scope of application

1.1 These

General Terms and Conditions apply exclusively to all deliveries, services and offers.

1.2 Amendments and additions to these terms and conditions, as well as collateral agreements, require the written confirmation of pet earth GmbH, Oberfeldstraße 3 , 32457 Porta Westfalica to be valid.

2. conclusion of contract

2.1 Prices quoted in adverts are subject to change and non-binding.

2.2 An order placed by the customer is binding.

2.3 The seller undertakes to accept the customer's order in accordance with the conditions on the website. In the event of typographical, printing and calculation errors on the website, the seller is entitled to withdraw from the contract.

3. prices and terms of payment

3.1 Our prices include the statutory value added tax.

3.2 Unless otherwise agreed, the purchase price must be paid upon receipt of the goods.

4. delivery periods

4.1 Dates and delivery periods are non-binding, unless expressly agreed otherwise in writing. Details of specific delivery periods and delivery dates are subject to correct and timely delivery by our suppliers.

4.2 The buyer cannot derive any claims for damages from delayed deliveries.

5. dispatch and transfer of risk

5.1 We are authorised to make partial deliveries unless otherwise agreed. Partial deliveries shall be deemed to be independent deliveries for the purposes of payment obligations, transfer of risk and warranty.

6. retention of title

6.1 The goods shall remain our property until all claims against the customer to which we are entitled on any legal grounds have been fulfilled.

7. warranty and limitation of liability

7.1 The warranty period is 2 years. It begins on the day of receipt of the delivery. Excluded from this are any remaining stock, used goods, returns and the like - here the warranty is shown separately!

7.2 In the event of a complaint, the buyer is obliged to send the defective item, including all accessories, to the seller at his own expense and risk with a precise description of the fault, stating the model and serial number and a copy of the invoice, properly packaged.

7.3 If a delivery item is defective or lacks a warranted characteristic, we are entitled to choose between replacement delivery or repair. Multiple rectifications are permissible.

7.4 If the second rectification or replacement delivery fails, the customer is entitled to demand a reduction in the purchase price or cancellation of the contract at his own discretion.

7.5 Obvious missing or incorrect deliveries must be reported within 7 days of receipt. The seller reserves the right to inspect the goods.

8. Returns

8.1 Unpaid shipments cannot be accepted. A copy of the invoice and, if applicable, a description of the fault must be enclosed with the return.

8.2 If the inspection of a returned item shows that the defect or damage claimed by the Buyer is not present, but that the item is free of defects and faults, the Seller is entitled to charge the Buyer for the inspection costs against payment of a lump sum of € 30.00 plus VAT per inspection. The Buyer reserves the right to provide evidence of lower costs, the Seller reserves the right to provide evidence of higher costs. In this case, the buyer must also pay the shipping costs. Inspection costs and dispatch expenses shall be charged against cash payment.

9. applicable law

9.1 The law of the Federal Republic of Germany shall apply to these Terms and Conditions and the business relationship between the Seller and the Buyer. Other national laws and international sales law are excluded.

10. place of fulfilment, place of jurisdiction

10.1 The place of fulfilment is the registered office of the seller.

10.2 The exclusive place of jurisdiction for all present and future claims arising from the business relationship with registered traders, including bills of exchange and cheque claims, shall be the registered office of the Seller.

10.3 The same place of jurisdiction shall apply if the buyer does not provide a general place of jurisdiction in Germany or if his domicile or usual place of residence is not known at the time the action is filed.

11. data protection

11.1 We are authorised to process all data relating to the business relationship with the customer in compliance with the Federal Data Protection Act.
